FractAlls is an online platform allowing users to buy products from various merchants either by Total Payment or by Payment via Contributions also called Payment by installments. Contributions can be made individually, with other Users or with FractAlls.

The terms below govern Purchases on FractAlls via the Payment by Contributions system with other users (Type RWS) or with FractAlls.

These conditions bind on the one hand: The Beneficiary: The one who reimburses or must reimburse the payment balance of a product obtained at the end of a sale via contributions.

And on the other hand: FractAlls

The terms are as follows:

1) The beneficiary must be the main user of the acquired product and cannot transfer its use to a third party as long as the product is not fully settled. For any purchase on behalf of a third party, ask to be added as the Guarantor of this third party who must be the main buyer and therefore the Beneficiary.

2) At each purchase, the Beneficiary certifies on his honor that he or his guarantor has a financial situation allowing the Beneficiary to acquire the product sold and pay its balance in installments under the established conditions. Otherwise, he must not validate the purchase.

3) The Beneficiary is required to repay the balance of its debt related to each purchase in fair monthly installments according to the conditions governing the sale of the product. The payments of monthly installments are made exclusively on the FractAlls platform.

4) The Beneficiary agrees to keep FractAlls informed of any change in its financial situation that could affect the repayment of the balance of its debt on purchases in progress of payment.

5) At the beginning of each month, an interest rate of 4.1% applies as late penalties on all balances not refunded during the previous month, relating to any product in the possession of the Beneficiary.

6) In case of difficulty in paying the balance of a purchase, the Beneficiary may return to FractAlls the purchased product in order to suspend the increase in interest rates related to late payments.

7) In case of unexplained disappearance of the Beneficiary who has not yet settled their purchase, FractAlls reserves the right to use all resources at its disposal to find the latter.

8) The product acquired during the purchase by contributions remains the property of FractAlls until the Beneficiary has completely settled the debt related to this purchase. FractAlls ensuring the recovery of debts related to purchases by contributions, therefore reserves the right to temporarily or permanently seize this product only in case of non-compliance with payment deadlines or death of the beneficiary.

9) In the event of a definitive return or definitive seizure of the product by FractAlls, FractAlls reserves the right to claim compensation from the Beneficiary. The value of the compensation will mainly be related to the condition of the recovered product, its total operating period and the amount already paid by the Beneficiary on the concerned product.

10) The accidental, voluntary or involuntary destruction of the product does not exclude the Beneficiary from payment of the balance related to the purchase of this product. However, in the event of proven involuntary destruction, late payment interest will cease to apply on the unpaid balance related to the product.

These terms of Purchase by Contribution cover all purchases made from the revision date below.
